1. Agreement to Terms

By accessing or using KanBandit ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, including free and paid subscribers. By creating an account or using the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

KanBandit is an AI-powered ticket generation platform that helps users create structured, professional project tickets and task descriptions. The Service includes:

• AI-powered ticket generation using advanced language models
• Customizable ticket templates
• Ticket management and organization tools
• Integration with project management platforms (e.g., Jira)
• User account management and settings

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities. You may terminate your account at any time by contacting support at support@kanbandit.ai.

4. Subscription and Billing

4.1 Pricing Plans

KanBandit offers various subscription plans with different credit allowances:

• Starter Plan: €10/month for 1,000 credits
• Bandit Plan: €15/month for 3,000 credits
• Enterprise Plan: Custom pricing for unlimited credits

Prices are subject to change with 30 days' notice. Current subscribers will be grandfathered into their existing pricing for the duration of their subscription period.

4.2 Billing and Payments

• Subscriptions are billed monthly in advance
• Payments are processed through secure third-party payment providers
• All fees are non-refundable unless otherwise stated
• Failed payments may result in service suspension
• You are responsible for all applicable taxes

4.3 Credits and Usage

Credits are used for AI-powered ticket generation. One ticket generation typically consumes 1 credit. Unused credits do not roll over to the next billing period unless you have an Enterprise plan with custom terms.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws, regulations, or third-party rights
• Generate harmful, illegal, or offensive content
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service's operation
• Use automated scripts or bots to access the Service
• Resell, redistribute, or sublicense access to the Service
• Reverse engineer or attempt to extract the source code of the Service
• Use the Service to compete with us or build a competing product

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, software, and content, is owned by KanBandit and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6.2 Your Content

You retain all rights to the content you input into the Service and the tickets generated using the Service. By using the Service, you grant us a limited license to process your inputs and generate tickets on your behalf. We do not claim ownership of your content or use it for purposes other than providing the Service.

7. AI-Generated Content

7.1 No Guarantee of Accuracy

The Service uses AI language models to generate ticket content. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or inconsistencies. You are responsible for reviewing and verifying all generated content before use.

7.2 User Responsibility

You are solely responsible for how you use AI-generated content. We are not liable for any consequences arising from your reliance on or use of such content, including business decisions, project management, or any other purpose.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of uninterrupted, error-free, or secure service
• Accuracy, reliability, or quality of AI-generated content
• Compatibility with third-party integrations (e.g., Jira)

We do not warrant that the Service will meet your requirements or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KANBANDIT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Errors or inaccuracies in AI-generated content
• Unauthorized access to your account or data

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless KanBandit and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to or generate using the Service

12. Changes to Service and Terms

12.1 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for such modifications.

12.2 Terms Updates

We may update these Terms from time to time. We will notify you of material changes by email or through a prominent notice on the Service. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the European Union and the jurisdiction where KanBandit is registered, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in the jurisdiction where KanBandit is registered.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and KanBandit regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
